Rights arising from liability for defects
The rights and obligations of the parties arising from liability for defects are governed by the law of the Slovak Republic, in particular by Sections 619 to 626 of the Civil Code (Act No. 40/1964 Coll., as amended) and by Act No. 108/2024 Coll. on consumer protection.
-
The seller is liable to the buyer for the goods being free of defects on receipt. In particular, the seller is liable that the goods:
match the description, type, quantity, quality, functionality and other characteristics agreed in the contract,
are fit for the purpose for which goods of the same kind are normally used, or for a purpose the buyer notified to the seller and the seller accepted,
correspond in quality or workmanship to the sample or model, where the quality or workmanship was determined by a sample or model,
are supplied in the corresponding quantity, measure or weight, and
meet legal requirements.
The seller is liable for defects that appear on the goods within 24 months of delivery. If a defect appears within this period, the goods are presumed to have been defective at delivery, unless this is incompatible with the nature of the goods or of the defect.
The buyer notifies the seller of the defect without undue delay after discovering it, and no later than the end of the period referred to in the previous point, by e-mail to obchod@boxmade.sk quoting the order number.
The seller will remedy the defect within a reasonable period, which may not exceed 30 days from the day the defect was notified. If the seller fails to remedy the defect within this period, the buyer is entitled to a proportionate price reduction or to withdraw from the contract.
The above does not apply to a defect for which a lower price was agreed, to wear and tear caused by ordinary use, or to a defect caused by improper handling, storage in unsuitable conditions (in particular damp) or use of the goods contrary to their purpose.
If the buyer is not a consumer but a business acquiring the goods in the course of its business activity, rights arising from liability for defects are governed by the Commercial Code (Act No. 513/1991 Coll.).
If a buyer who is a consumer is not satisfied with the way the complaint was settled, they have the right to ask the seller for redress and then to submit a proposal for alternative dispute resolution, for example through the Slovak Trade Inspection (Slovenská obchodná inšpekcia).
