1 – Introductory provisions

These Terms and Conditions were drawn up on the basis of Act No. 108/2024 Coll. on consumer protection. They govern the rights and obligations of the parties to a purchase contract between the Seller and the Buyer, where the Buyer is either a consumer, or a business, or a state or local authority. The contract is concluded on the basis of the Buyer’s order and its acceptance by the Seller.

2 – User account

An account is created automatically with your order. You can also order without registering. Keep your access details confidential; the Seller may cancel an account that is not used or that is used in breach of these terms.

3 – Conclusion of the purchase contract

The presentation of goods in the online shop is informative; the contract arises when the Seller accepts the Buyer’s order. For made-to-measure production, the contract arises on confirmation of the quotation.

4 – Prices and payment

Prices are stated in EUR. Prices in the printed catalogue, which is intended for business customers, are exclusive of VAT and do not include any further taxes, charges or delivery costs. You can pay by debit or credit card, via Apple Pay or Google Pay; online payments are handled by the Stripe payment gateway. Cash on delivery is not available.

5 – Withdrawal from the contract

Consumers. A Buyer who is a consumer may withdraw from the contract without giving a reason within 14 days of receiving the goods. The goods must be sent back or handed over within 14 days of withdrawal, and the Seller returns all payments received, including delivery costs, within 14 days of receiving the notice of withdrawal.

Box Made voluntarily gives all customers a longer period of 30 days to return goods – see Returning goods.

Business customers. Withdrawal is governed by Section 344 et seq. of the Commercial Code. Either party may withdraw if the other party breaches the contract materially, or breaches it non-materially and fails to remedy the consequences within a reasonable period despite being asked to do so. The Seller may also withdraw without an additional period if enforcement proceedings are brought against the Buyer or if a petition for bankruptcy or restructuring of the Buyer’s assets is filed.

Goods made to measure are produced to the Buyer’s own specification and the statutory right of withdrawal does not apply to them.

6 – Delivery

Delivery within Slovakia is handled by the courier companies SDS and DPD. Stock sizes are usually dispatched within 1 – 3 working days of order confirmation; for made-to-measure production the date is confirmed in the quotation. The shipping price is calculated from the weight of the consignment and is shown in the cart before the order is completed. Collection in person in Jablonica is free. Delivery outside Slovakia is quoted individually – write to obchod@boxmade.sk. Details are on the page Shipping and payment.

The Buyer is obliged to take delivery of the goods. On receipt, check that the packaging is intact and report any damage to the carrier without delay.

7 – Rights arising from defective performance

Governed by Sections 619 to 626 of the Civil Code (Act No. 40/1964 Coll.) and by Act No. 108/2024 Coll. The Seller is liable for defects that appear within 24 months of delivery, and will remedy a defect within a reasonable period not exceeding 30 days from notification. 8 – Further rights and obligations of the parties

The Buyer acquires ownership of the goods on payment of the full purchase price. The Seller is not bound by any code of conduct in relation to the Buyer.

9 – Personal data

The processing of personal data is described on the page Personal data protection.

10 – Commercial communications and cookies

The Buyer agrees to receive information relating to the Seller’s goods, services or business at the e-mail address provided, and consents to cookies being stored on their device. Consent can be withdrawn at any time.

11 – Packaging costs

The Seller has concluded a collective compliance agreement with the authorised packaging organisation Natur-Pack a.s. covering reporting on the packaging it uses to transport goods safely, and its producer obligations for waste electrical equipment through that operator’s collective scheme. Any recycling fee for electrical waste is included in the price of the product concerned. The Seller provides for the take-back of packaging.

12 – Delivery of notices

Notices may be delivered to the Buyer at their e-mail address. Notices to the Seller may be delivered by post to its registered office or to the e-mail address given above.

13 – Use of the Seller’s website

The content of the website, including photographs, drawings and texts, is protected by copyright and may not be used without the Seller’s consent.

14 – Final provisions

If the relationship established by the purchase contract contains an international element, the parties agree that it is governed by the law of the Slovak Republic. This choice of law does not deprive a Buyer who is a consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence.

A consumer who is not satisfied with the way a complaint was settled may ask the Seller for redress and then submit a proposal for alternative dispute resolution, for example through the Slovak Trade Inspection (Slovenská obchodná inšpekcia), or through the European Commission’s online dispute resolution platform.

The Seller may amend these Terms and Conditions; this does not affect rights and obligations that arose while an earlier version was in force.
